The Pittsburgh Group, Inc. doing business as ERCZilla ("Company," "we," "us," or "our") operates the website erczilla.com (the "Site"). By accessing or using our Site and services, you ("User," "Client," or "you") agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully. If you do not agree to these Terms, you must not access or use the Site.

1. Acceptance of Terms

By accessing the Site, requesting information, or engaging our services, you represent and warrant that you have the legal authority to accept these Terms on behalf of yourself or the municipality/organization you represent. You further agree that your use of the Site signifies your acceptance of this Agreement.

2. Nature of Services

2.1. Settlement Recovery Consulting ERCZilla provides consulting services to assist eligible public water systems and municipalities in identifying, documenting, and submitting claims for class action settlements, including but not limited to the 3M and DuPont PFAS Settlements.

2.2. Not a Law Firm ERCZilla is not a law firm and does not provide legal advice. Our services are limited to administrative support, data aggregation, testing coordination, and claims processing. Any information provided on this Site is for informational purposes only and should not be construed as legal advice. If you require legal advice, you should consult with a qualified attorney.

2.3. Not a Government Agency We are a private consulting firm. We are not affiliated with the United States Environmental Protection Agency (EPA), the Court-appointed Settlement Administrator, or any other government entity.

3. User Obligations

3.1. Accuracy of Information You agree to provide true, accurate, current, and complete information about your municipality and water systems as prompted by our eligibility assessment forms. You acknowledge that submitting false or misleading information to a Settlement Administrator may result in the rejection of your claim or legal penalties.

3.2. Authorization If you submit data on behalf of a municipality, you warrant that you are an authorized representative of that entity with the power to share such operational data.

3.3. Prohibited Uses You agree not to use the Site to:

• Violate any applicable federal, state, local, or international law.

• Impersonate any person or entity, or falsely state your affiliation with a person or entity.

• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.

4. No Guarantee of Results

4.1. Financial Estimates Any estimated recovery amounts provided on the Site or during preliminary consultations are estimates based on available settlement data and similar case studies. We do not guarantee that your municipality will recover a specific amount, or any amount at all. Final recovery amounts are determined solely by the Settlement Administrator based on the final claims data and court-approved allocation formulas.

4.2. Contingency Model Our recovery services are provided on a contingency basis, meaning our fees are contingent upon the successful recovery of funds. Specific fee structures and terms will be outlined in a separate written Service Agreement signed by both parties.

5. Intellectual Property Rights

5.1. Ownership The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by The Pittsburgh Group, Inc., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5.2. Limited License These Terms permit you to use the Site for your legitimate business purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site.

6. Disclaimer of Warranties

YOUR USE OF THE SITE IS AT YOUR OWN RISK. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

7. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE PITTSBURGH GROUP, INC., ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, OR LOSS OF DATA.

8. Indemnification

You agree to defend, indemnify, and hold harmless The Pittsburgh Group, Inc., its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

9. Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the Commonwealth of Virginia without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Virginia.

10. Changes to the Terms of Service

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms of Service means that you accept and agree to the changes.
