Unrestricted Capital for Your Community
Settlement funds are damages rather than grants. You retain full local control.
Unlike many state or federal grants, PFAS settlement funds are generally not restricted to water-related projects. Once recovered, these funds become discretionary revenue for your municipality. You determine the priority.
-
Tackle deferred maintenance projects immediately. Use these funds to repair aging roads, bridges, and utilities without issuing new bonds or raising taxes.
-
Modernize your emergency fleet and protective gear. Ensure your police and fire departments have critical resources without straining the general operating budget.
-
Revitalize the high-traffic assets residents value most. Direct capital to renovate public parks, libraries, and recreational centers to improve local quality of life.
-
Strengthen your overall fiscal position with unrestricted revenue. Use the recovery to replenish rainy day funds, pay down existing debt, or close projected budget deficits.
-
Proactively upgrade treatment facilities and distribution lines. Prepare your utility for future EPA regulations while addressing current efficiency needs and reducing water loss.
-
Pay down unfunded pension liabilities or retire existing municipal bonds early. Reduce long-term interest costs to free up future cash flow for other priorities.
-
Seed local revitalization projects. Invest in downtown streetscapes, business incentives, or industrial park improvements that drive long-term tax revenue growth.
-
Mitigate flooding risks and upgrade aging drainage systems. Tackle expensive environmental compliance projects that often struggle to find room in the annual budget.
CRITICAL DEADLINES
The settlement window is strictly defined. Missing these dates results in a permanent forfeiture of funds. Furthermore, by remaining in the class, water systems have already waived the right to sue independently.
Now Active Enrollment & Testing Window
This is the critical operational period. We are currently coordinating source-water testing and compiling historical data for eligible systems. If you have not started the testing process, you are behind schedule.
Jan 1, 2026 Testing Cost Reimbursement Deadline
The final deadline to file claims for the reimbursement of testing costs. This applies specifically to systems that were not required to test under state law but incurred expenses to verify eligibility.
June 30, 2026 DuPont Action Fund Deadline
The absolute cutoff for submitting claims against the $1.185 billion DuPont settlement fund. Claims submitted after this date will be rejected automatically.
July 31, 2026 3M Action Fund Deadline
The filing deadline for the $10.5 billion 3M settlement fund. This represents the largest portion of available capital. Missing this date means forfeiting your municipality's share of the primary settlement.
Aug 1, 2026 Special Needs Fund Deadline
The final date to request reimbursement for past capital expenditures. If your municipality has already spent money remediating PFAS (e.g., new treatment facilities or taking wells offline), this is your deadline to recover those costs.
If your municipality fails to file by the deadline, you will permanently forfeit your right to these funds.
